Tax Migration of Retirees to Greece: The Alternative Regime Under Article 5B of Law 4172/2013

Greece offers a particularly attractive tax environment to attract foreign retirees who wish to transfer their tax residence to the country. A key component of this framework is Article 5B of Law 4172/2013, which provides for favorable, separate taxation of income earned abroad.

1. Who Is Eligible and What Are the Requirements?

The regime applies exclusively to individuals—retirees who receive a pension from a foreign entity. To qualify, all of the following conditions must be met cumulatively:

  • Income from a Foreign Pension: The applicant must be the recipient of pension income (primary, supplementary, occupational, or from group insurance policies) originating outside Greece.
  • Previous Tax Residency: The individual must not have been a tax resident of Greece for five (5) of the six (6) years preceding the transfer of their residence.
  • Country of Origin: The transfer of tax residency must be from a country with which Greece has a valid administrative cooperation agreement in the tax field.

2. The Tax Advantage: Flat Tax of 7%

The main attraction of this regime is the method of filing and paying the tax:

  • 7% Flat Tax: All pension income earned abroad is taxed at a single, flat rate of seven percent (7%).
  • Exhaustion of Tax Liability & Exemptions: Payment of this tax exhausts any tax liability on the income in question, and no special solidarity levy is imposed.
  • How This Applies to International Tax Treaties (Double Taxation Agreements): These rules apply in conjunction with Double Taxation Agreements. Generally, public pensions are taxed in the source country, while private pensions (provided the DTA allows it) are subject exclusively to the Greek tax rate of 7%.
  • Note on Inheritances: There is no exemption from inheritance or gift tax for assets located abroad.

3. Procedure and Application Submission

The application must be filed with the competent Tax Administration office, accompanied by the necessary supporting documents and evidence, within the deadlines specified by law.

4. Duration and Conditions for Maintenance

  • Duration of Validity: The preferential tax regime is valid for a total of fifteen (15) tax years and cannot be extended; the tax is paid in a lump sum each tax year.
  • Risk of Loss: If, in any given year, the retiree fails to pay the full amount of tax by the deadline, they are retroactively excluded from the regime for that specific year and revert to the general tax scale on their worldwide income.
  • Right of Withdrawal: Of course, the taxpayer has the option at any time to withdraw from this scheme and return to the standard tax regime.

This special tax regime represents a golden opportunity for those seeking to enjoy a peaceful retirement amidst the beauty of Greece, without worrying about onerous taxes on their pensions. At Nexus, we handle the entire process described above, offering you a smooth transition to our country.
