THE PROCEDURAL STEPS OF A CRIMINAL TRIAL (PRE-TRIAL – TRIAL)
Criminal law in Greece is constituted by a clearly defined institutional framework that regulates both criminal acts and the procedure by which they are investigated and tried. The main sources of Greek criminal law are the Criminal Code and the Code of Criminal Procedure. The former includes the rules that define what conduct constitutes a crime and what penalties are provided, while the latter determines the procedure by which crimes are investigated and tried.
Based on this distinction, criminal law is divided into substantive criminal law and criminal procedure. Substantive criminal law determines the content of criminal acts and the sanctions provided for, while criminal procedure regulates the stages of criminal proceedings, the rights of the parties and the way criminal justice operates.
Criminal proceedings usually develop in three main stages. The first is the pre-trial phase, during which actions such as the preliminary examination, the preliminary investigation and the main investigation take place, with the aim of collecting evidence and establishing the validity of the accusation. This is followed by the preparatory hearing phase, during which it is examined whether the case should be brought to trial. Finally, at the hearing phase, the case is publicly discussed before the competent criminal courts, where the evidence is assessed and the court decision is issued.
It is important to distinguish criminal law from civil law. Criminal cases, which concern criminal acts and the imposition of penalties, are tried by criminal courts, while private disputes between citizens are resolved by civil courts under civil law. This ensures the proper functioning of the legal order and the effective administration of justice.
